Can I recover if I wasn’t wearing a helmet?
Texas law does not bar recovery simply because a rider wasn’t wearing a helmet for those legally allowed to ride without one. Helmet use may be raised by the defense, but it doesn’t automatically end your claim — we address it head-on.
What if I was partially at fault?
Texas uses modified comparative negligence. As long as you were not more than 50% responsible, you may still recover, reduced by your share of fault. We work to minimize any fault assigned to you.
